Terms of Use
These terms apply to the Dotcross websites, the web app at app.dotcross.app and the early-access beta, including the waitlist (together, the "services").
Agreement
These Terms of Use are an agreement between you and Dotcross LLC, a Texas limited liability company ("Dotcross", "we", "us" or "our"). By creating an account or using the services you agree to them. If you do not agree, do not use the services.
Early-access beta and pre-release features
Dotcross is in an invite-only beta. Joining the waitlist does not by itself give you access; we send invites at our discretion.
Beta and pre-release features may be incomplete, may contain errors, may be unavailable at times, and may change or end. Do not rely on them as your only copy of any record.
Eligibility
You must be at least 18 years old and live in the United States to use the services.
Your account
Give accurate information, keep your sign-in (your Google account or email inbox) secure, and use one account per person. You are responsible for what happens under your account. Tell us promptly if you think someone else has used it.
No tax advice, preparation or filing
Dotcross organizes and checks your records. It does not provide tax, legal or financial advice and does not prepare or file tax returns. You and your tax preparer are responsible for your return.
Acceptable use
You agree not to:
- abuse, overload or disrupt the services, or try to get around their security;
- scrape or collect data from the services by automated means;
- reverse engineer the services, except where the law allows it;
- create accounts automatically, in bulk, or for someone else;
- use the services to break the law or the rights of others.
Third-party services
Some features rely on services run by others, such as Google sign-in. Your use of those services is governed by their own terms and privacy policies. We are not responsible for services we do not run.
Changes to the services
We may add, change, suspend or stop any part of the services, including ending the beta. Where a change materially affects you, we will try to tell you in advance by email.
Our content and trademarks
Dotcross™, the Dotcross logo and the content of the services belong to Dotcross LLC. You may not use them without our permission, except to refer to the services.
Feedback
If you send us ideas or suggestions, you give us permission to use them, worldwide and without payment or obligation to you.
Privacy
Our Privacy Policy explains what we collect and how we use it.
Ending your use
You can delete your account at any time from your account page. We may suspend or close an account that misuses the services or breaks these terms. The sections on feedback, disclaimers, limitation of liability, indemnification, dispute resolution and governing law continue to apply after your use ends.
Disclaimers
During the beta the services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.
Limitation of liability
To the extent permitted by law, Dotcross LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of the services.
To the extent permitted by law, our total liability for all claims relating to the services is limited to the greater of the amounts you paid us for the services in the 12 months before the claim or US$100.
Some states do not allow some of these limits, so they may not all apply to you.
Indemnification
You agree to defend, indemnify and hold harmless Dotcross LLC and its members, managers and employees from claims, losses and costs (including reasonable attorneys' fees) arising from your misuse of the services or your violation of these terms or the law.
Dispute resolution
If you have a dispute with us, first email info@dotcross.app and describe it. We will both try to resolve it informally for 30 days.
If it is not resolved, the dispute will be heard only in the state or federal courts located in Texas, and you and we consent to the personal jurisdiction of those courts.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Notices
We send notices by email to the address on your account; they count as received when sent. Send notices to us at info@dotcross.app.
Assignment
You may not transfer these terms or your account without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
Severability
If a court finds part of these terms unenforceable, the rest stays in effect.
No waiver
If we do not enforce a part of these terms, that is not a waiver of our right to enforce it later.
Entire agreement
These terms and the Privacy Policy are the whole agreement between you and us about the services, and replace any earlier agreement about them.
Changes to these terms
When these terms change we post a new version here with a new effective date, and notify account holders by email if a change is material. The app may ask you to accept the new version before you continue.
